These Terms govern your use of:

  • www.popologynetworks.com
  • www.popology.app
  • 所有相关的移动应用、产品、服务、智能合同 POPOLOGY Megaverse LLC 和 POPOLOGY Global Corp (统称“POPOLOGY”、“我们”、“我们”或“我们”)。

2. A. 本协定的范围

这些条款适用于所有以下用户：

  • 访问、注册或使用POPLOGY平台的任何部分。
  • 使用服务、功能、奖励、NFT、POPtokensTM和POPmercial：注册系统.
  • 访问或与我们的 Web3 集成、区块链合约或分散治理工具交互。

您也可以根据您所使用的功能或服务而受到补充策略的约束，包括但不限于：

  • POPcast®️ 串流
  • 广告宣传运动
  • 标记的 NFT
  • 通过POPOLOGY Academy for Media Articles (P.A.F.M.A.)
  • 创建者/影响者工具

3. 账户注册和责任

  • 使用POPOLOGY必须至少13岁(或在你的管辖区内成年年龄)。
  • 您同意提供真实、准确的信息并随时更新。
  • 您有责任为您的登录凭据保密。
  • POPOLOGY 对未经授权使用您的帐户不负赔偿责任。
  • 您不能转账或出售您的帐户。
  • 用户必须整合至少 3 个活跃平台才能在 POPOLOGY:注册中使用：POPsphereTM 元搜索引擎。

4. 内容所有权 & 许可协议

您保留对您创建和分享的任何内容的完全所有权。 然而，通过将内容上传到POPOLOGY，您会向我们颁发一份世界范围的免费、可收取使用费的许可协议。 仅为平台相关目的显示、发布和推广内容，包括：

  • POPmercial®️ placements
  • POPOLOGIST®️ Influencer shares
  • 公众信任LedgerTM 见解。
  • 基于智能合同的 BrandSmartTM 准则

通过上传，您可以授予POPOLOGY全球许可证，通过互联网、移动电话、OTT和未来广播格式分发您的广播内容。

您完全有责任获得您广播的内容中的所有权利(包括音乐、同步和表演权)。 如果权利有争议，POPOLOGY 可以删除内容。

现场广播政策

为了保护平台的完整性和遵守法律：

  • 没有未经授权的流: 不要未经许可使用版权或许可内容(体育、音乐会、PPV等)。
  • 没有非法内容： 非法活动或非法使用平台是被禁止的。
  • 没有假冒： 不要假冒新闻渠道、紧急服务或当局。 Satire/parody 必须明确标记。
  • 广播完整性： 流必须是真实的。 必须披露假冒或操纵的“现场”流。

违反行为可能导致中止或终止。

此许可证在您的内容被删除或账户被终止时终止，除非出于法律、审计或证据方面的需要。

我们遵守美国的规定。 DMCA。 版权所有者可以向 contact@popologynetworks.com 提交已获取的通知。

5. 奖品与奖励

POLOGY 提供多条路径奖励：

  • POPs™: 通过内容挖掘、互动或绩效指标获得。 1000 POPs = 1 POPOLOGY®️coin.
  • 代币值免责声明： POPOLOGY®️ 这些代币是数字实用代币，仅供在 POPOLOGY 平台内使用。 它们不能保证生态系统以外的货币价值。
  • 税： 用户负责报告和支付税款。 持久性有机污染物可视需要扣缴税（IRS W-9/W-8）。
  • 赞助内容：必须遵守适用法律（FTC、欧盟影响者准则）。

奖励是对贡献的奖励，而不是投资。 欺诈或违法行为可能导致扣留或收回报酬。

6. 行为守则

您不能使用POPOLOGY 到：

  • 非法的、滥用的、威胁性的或歧视性的内容。
  • 误导听众、干扰选举或冒名顶替新闻。
  • 侵犯第三方IP。
  • 干扰安全、区块链或共识。
  • 垃圾邮件、扫描、假冒或操纵系统。
  • 数字权利或许可权的规律。

年龄限制的内容必须适当标记。 POPOLOGY 不是紧急广播服务。

违反行为可能导致撤职、中止或终止。

7. 隐私 & 数据使用

关于数据收集和使用的详细信息，请参阅我们的 隐私政策。 原则：

  • 数据最小化
  • 目的限制
  • 用户同意
  • 链上透明度

8. 平台完整性 & 分散化

  • 使用 AI 和 moderation 工具来检测滥用情况。
  • POPcast®️ 广告投放符合规定 BrandSmartTM Guidelines
  • POPOLOGY 可以从列表中删除或删除违反政策的内容、用户或流。

9. 第三方服务 & 链接

POPOLOGY 可以链接到或整合第三方钱包、交易所或市场。 我们不对他们的做法负责。 使用风险自担。

10. 知识产权

POPOLOGY®, POPOLOGIST®, POPcast®, POPmercial®, POPsphere™, POPs™, BrandSmart™, Public Trust Ledger™, and related marks are trademarks of POPOLOGY Global Corp.

11. 平台暂停或终止

我们可以暂停或终止您的帐户：

  • 违反条款/政策。
  • 4. 非法或滥用行为。
  • 2. 对廉正或安全的威胁。

用户可以随时终止他们的帐户。

执法与罢工

  • 第一次违反行为： 警告或临时限制。
  • 第二次违约： 暂时中止。
  • 第三次违规：延长停职或解雇期限。严重侵权行为可能立即终止。

申诉程序

用户可对暂停或移送提出申诉。 上诉由一个单独的调解小组审查。

12. 免责声明

持久性有机污染物平台提供了 “现状” 和 “可用”。 不保证不间断或无误服务。

13. 赔偿责任限制

POPOLOGY 对间接、特别、附带或间接损害不负赔偿责任。 用户对他们上传的内容单独负责。

您同意从因您的内容或使用而引起的索偿或损坏中赔偿POPOLOGY。

14. 争端解决

  • 消费者争端： 宾夕法尼亚州法律管辖，由宾夕法尼亚法院解决(除非另有要求)。
  • 商业纠纷： 疏忽公司法 (除非另有具体规定)。

美国 用户

  • 仲裁协议： 争端完全通过具有约束力的仲裁解决（小索赔除外）。
  • 类行动等待： 争端仅以个人为基础。
  • 规则： AAA 规则下的仲裁，受《联邦仲裁法》管辖。
  • 选择退出： 您可以在30天内通过书面通知选择退出仲裁。

POPOLOGY 可以在无赔偿责任的情况下添加、修改或删除功能。

Third-Party Platform Compliance

POPOLOGY® is an interoperable media and data infrastructure that integrates with, aggregates, indexes, references, embeds, or otherwise interfaces with third-party platforms, application programming interfaces ("APIs"), search services, content providers, and digital media services (collectively, "Third-Party Platforms"), including, without limitation, YouTube, Google, TikTok, Instagram, Facebook, Vimeo, Dailymotion, Kick, PeerTube, Odysee, Rumble, Bilibili, Shutterstock, Pexels, Pixabay, Brave Search, Yandex, NineGAG, BitChute, and any other current or future platforms supported by the POPOLOGY® Infrastructure.

By accessing, searching, uploading, curating, publishing, embedding, sharing, or otherwise interacting with content originating from any Third-Party Platform through POPOLOGY®, you acknowledge and agree that your use of such content remains subject to the applicable Terms of Service, Developer Policies, Community Guidelines, Privacy Policies, Intellectual Property requirements, API license conditions, and all other legal obligations imposed by the respective Third-Party Platform.

Nothing contained within the POPOLOGY® Infrastructure or these Terms shall be construed as modifying, superseding, waiving, or replacing the contractual obligations, intellectual property rights, or legal requirements established by any Third-Party Platform. Users remain solely responsible for ensuring their activities comply with all applicable third-party terms governing the content they access, upload, curate, publish, distribute, or otherwise interact with through POPOLOGY®.

POPOLOGY® provides independent infrastructure services for media discovery, cross-platform search, content curation, attribution, digital rights management support, analytics, verified digital attention, and related technologies. POPOLOGY® does not grant any rights, licenses, permissions, or authorizations beyond those expressly granted by the applicable Third-Party Platform or by applicable law.

Where a Third-Party Platform requires specific user acknowledgements, disclosures, attribution, privacy notices, API usage conditions, or additional contractual obligations as a condition of access to its services, such requirements are incorporated into these Terms by reference and shall apply to all users to the extent required by the applicable Third-Party Platform.

POPOLOGY® reserves the right to modify, suspend, restrict, or terminate any Third-Party Platform integration, content availability, or related functionality at any time to maintain compliance with applicable laws, contractual obligations, developer policies, intellectual property requirements, or platform-specific terms.

YouTube API Services

POPOLOGY uses YouTube API Services to provide features that retrieve, organize, display, and play YouTube content.

By accessing or using POPOLOGY and its YouTube-related features, you acknowledge and agree to be bound by the YouTube Terms of Service, available at:

https://www.youtube.com/t/terms

You may not use POPOLOGY in any manner that violates the YouTube Terms of Service, applicable Google or YouTube policies, or applicable law.
